<br /> <br />1/80 <br />SECTION 35.5 <br />-J <br />ADDITIONAL DEVELOPMENT REQUIREMENTS <br />1. A certificate of designation as required by the Colorado Revised <br />Statutes shall be obtained from the E1 Paso County Board of Commissioners. <br />2. The use shall be conducted within an entirely enclosed building. <br />3. All coal shall be stored in closed bins or structures; however, no <br />such bin or structure need have a roof thereon if it has solid <br />dust-proof walls and door is at least seven (7) feet in height and no <br />coal is placed or kep nearer than two (2) feet from the opening of <br />the bin or structure. <br />4. Shall be limited to a minimum lot area of 2.5 acres for principal <br />auditorium capacities up to, and inclusive of, 300 seats. For <br />capacities in excess of 300 seats, the minimum lot area shall be four <br />(4) acres. No portion of any principal or accessory building shall <br />be less than fifty feet from any front property lines of any <br />adjoining street. On-site parking lots and other areas subject to <br />vehicular traffic shall be adequately screened from adjoining residential <br />lot lines by a fence, minimum height of 3.5 feet, constructed of <br />suitable material or closely planted evergreens or hedges and forever <br />maintained. All illumination of the on-site parking facilities shall <br />be located so as [o be contained on the premises. <br />5. Regulations necessary for the operation of a landfill for the public <br />health, safety and welfare: <br />The petitioner shall agree to the following regulations as a condition <br />to the granting of the location by the Planning Commission: <br />a. The area shall be surrounded by a portable fence covering <br />the iimnediate area. <br />b. Refuse shall be covered by earth to a depth of twenty-four (24) <br />inches above the finished surface. <br />c. Waste building material, concrete or other bulky waste shall not <br />be used for the final surface or side slopes. <br />d. The exposed surface shall be covered with six (6) inches of earth <br />at the close of each day's operation. <br />e. The toe of any finished fill slope shall terminate in a sand and <br />gravel filled ditch. <br />6. A petitioner for approval of a mineral and natural resource extraction <br />operation shall submit copies of the documentation as required by the <br />State of Colorado when applying for a permit to mine under the Colorado <br />Revised Statutes. <br />Standards Governing the Approval or Disapproval of an Application for <br />Mineral and Natural Resource Extraction Operation: <br />144 <br />
