Further clarification is still <br />required as outlined below. As we discussed today, the DMG is <br />required to make an approval or denial decision no later than <br />January 2, 1997. If you feel more time is needed to complete your <br />reply, an extension to the decision date can be granted upon <br />receipt of a written waiver of your right to a decision by January <br />2, 1997 and request for additional time. <br />1. Please refer to page E-3 in Exhibit E of the application under <br />'Revegetation.' The first sentence states,"The purpose of <br />revegetation is to re-establish the pasture grasses for cattle <br />and horses in Phases 2 and 3." Unless this stated post mining <br />land use is changed, the applicant will need to commit to <br />stockpiling and replacing a minimum 12 inches of topsoil. <br />2. Before the application can be approved, the applicant will <br />need to answer the questions and provide the information <br />required in Rule 3.1.5(9)(a)-(e). <br />3. Per our discussion today, the DMG can approve the application <br />
