BAXSTROM of 3555 C.R. 307, Durango, Colorado (hereinafter <br />referted to as "Grantor"), and AGRI-DLD, L.L.C., a Colorado Limited Liability Company <br />(hereinafter referred to as "Grantee"). <br />WITNESSETH THAT: <br />For TEN DOLLARS ($10.00) AND OTHER GOOD AND VALUABLE <br />CONSIDERATION, the receipt and sufficiency of which is hereby acknowledged, Grantor hereby <br />conveys, delivers, transfers and sells unto the Grantee, its successors and assigns, licensees, etc., a <br />non-exclusive, perpetual access and utility Easement for, among other uses, ingress and egress to the <br />real property otherwise owned and/or occupied by Grantee; said Easement being more particularly <br />described as follows, to wit: <br />See Exhibit "A", attached hereto and inwrporated herein by this reference, and <br />the following description of the non-exclusive, perpetual easement. <br />This grant is intended to establish a sixty (60) foot wide non-exclusive and <br />perpetual access and utility easement which shall serve as the means of ingress <br />and egress for the Grantee over and aaoss Grantor's property located inthe SE'/. <br />NE'/., N'/, SE'h andthe NE'/. SW'/. of Section 35, T34N (SUL), R9W, N.M.P.M., <br />and more particularly described in the attached Exhibit "A". <br />The Easement is for the benefit and use of, and runs with and is appurtenant to Grantee's <br />property, for the purposes above-described and as further legally described and set forth in the <br />attached Exhibit "A". <br />IN W ITNESS W HEREOF, the Grantor has hereunto set its hand and seal the day and year <br />fast above written. <br />HAROLD L.
