This item could have been listed more appropriately under Exhibit E -Reclamation Plan, <br />as it applies to Rule 3.1.7 groundwater specific requirements. The Division under Senate <br />Bill 181 is required to implement the Water Quality Control Commission's groundwater <br />protection rules in regard to mining. <br />In response to our request for the applicant's plan for containing and disposing of spills <br />of petrochemical products from fuel storage and asphalt batching facilities, you stated <br />that a SPCC plan is a potential requirement of the Colorado Department of Public Health <br />and Environment (CDPHE) and that All Rite Paving and Redi-Mix will comply with <br />CDPHE regulations regarding a stormwater permit that will be required. The CDPHE's <br />responsibility and authority is in regard to stormwater runoff (surface water). Our <br />Division's responsibility and authority is in regard to groundwater quality standards, <br />when a mining operation has the potential to adversely affect ground water quality. <br />Please provide the applicant's plan to contain potential fuel and/or asphalt batching <br />petrochemical spills for the protection of groundwater quality. Your plan should include <br />a facility or facilities that will contain at least 125%o of the maximum capacity of all <br />petrochemical storage tanks with a potential to leak to that facility. The facility or <br />facilities can be constructed of low permeability (no more than IO-6 cm/sec) materials <br />with an absorption material that will soak up spills and can then be later disposed of. Or, <br />[he facility can include in its construction impermeable materials such as a membrane <br />capable of retaining such spills. Include plans for disposal of spilled petrochemicals.' <br />You should also include a commitment by the applicant to notify the Division within 24 <br />hours of a major spill. <br />Exhibit E -Reclamation Plan <br />OK <br />2.
