returned to the Property as unneeded or unused for <br />the job or project for which it was produced. <br />b. Import Fee on Recycle Material. Lessee shall pay <br />an import fee of ~n for each ton of Recycle Material <br />deposited by Lessee or its concrete or asphalt sublessee on the <br />Property. Such payment shall become due when the Recycle <br />Material is reprocessed and used for new asphaltic or concrete <br />products or otherwise sold and removed from the Property. Such <br />import fee shall be in lieu of any other Production Royalty or <br />Override Fee for the Sand and Gravel contained in such material. <br />The import fee shall be subject to adjustment in the same manner <br />as Production Royalty and other amounts pursuant to Paragraph B <br />of Section 4.3 of the Lease. <br />c. No Fee on Waste Material. There shall be no <br />override or import fee for waste Material returned to the <br />Property as to which a Sand and Gravel Fee was previously <br />payable. <br />d. Accounting. Recycle or Waste Material shall be <br />weighed upon delivery or return to the Property, with the <br />quantity and type of material being recorded. Products containing <br />reprocessed Recycle or waste Material shall be weighed upon <br />leaving the Property in the same manner as other products <br />containing Sand and Gravel under the Lease. Recycle and Waste <br />Material may be commingled in a single stockpile only after being <br />weighed and properly accounted for. Withdrawals from any such <br />stockpile for production of new asphaltic or concrete products <br />shall be deemed to be on a "first-in first-out" basis for <br />determining when payment of the import fee for Recycle Material <br />included in the commingled stockpile becomes payable. <br />e. Limits on Stockpiles. In no event shall Lessee <br />allow more than twenty thousand (20,000) tons of Recycle and <br />Waste Material to be stockpiled at any one time on the Property. <br />If the weighed Recycle and Waste Material returned to the <br />Property exceeds that used and removed from the Property by more <br />than 20,000 tons, Lessee shall cease delivering and stockpiling <br />Recycle and Waste Material until it has crushed and reused <br />sufficient stockpiled Recycle and Waste Material for asphalt or <br />concrete so as to reduce the stockpiled amount below 20,000 tons. <br />During the final three years of the Term of the Lease under <br />Section 2 thereof, no Recycle Material shall be stockpiled on the <br />Property and any returned Waste Material shall be promptly <br />processed and reused in the asphalt plant or concrete plant, as <br />applicable. <br />f. Limit on Source. '"he right to stockpile and reuse <br />Recycle Material shall be limited to Recycle Material generated <br />or salvaged by Lessee or its asphalt or concrete plant sublessee <br />in connection with jobs or projects where Sand and Gravel is <br />being used for paving or concrete pouring with product on which a <br />Sand and Gravel Fee has accrued, and the right to stockpile and <br />reuse waste Material shall be limited to such Material that has <br />been subjected to a Sand and Gravel Fee upon its removal from the <br />Property.
