That the proposal as conditioned below is in substantial con- <br />formance with the criteria of tl~e major issue areas of the <br />Jefferson County Mineral Extraction Policy Plan component of <br />the Jefferson County Comprehensive Plan. In the areas of <br />potential non-conformance, problems can be effectively <br />addressed at the time of site p1ar. review, as required below. <br />4. That the proposed land use as conditioned below is compatible <br />with allowable and existing land uses in the surrounding area <br />in all directions. This operation; if conducted in accor- <br />dance with the conditions set forth below together with the <br />restrictions of the Official Development Plan, will not have <br />negativo impacts upon traffic, water, air, noise and visual <br />quality for residents in the Brea, and therefore will be com- <br />patible with surrounding residential and park uses. <br />5. That a commercial mineral deposit ns defined by the <br />Preservation of Commercial Mineral Deposits Act exists upon the <br />subject property. <br />6. That Eor the above stated reasons, the applied for rezoning as <br />conditioned below is in the best interest of the health, <br />safety, morals, convenience, order, prosperity and welfare of <br />the citizens of Jefferson County. <br />NO'A, THEREFORE, BE IT RESOLVED that Rezoning Application Case No. <br />Z83-71 to amend Jefferson County Zoning Maps Nos. 73, 74, 102 and <br />103 to include within the Planned-Development (P-D) Zone District <br />and to exclude from Agricultural-Two (A-2) Zone District the <br />following described unincorporated area of Jefferson County, be <br />and hereby is APPROVED, subject to the addition of the following <br />conditions in the Official Development Plan and subject to filing <br />of the Official Develop~Aent Plan as so amended: <br />1. The operation shall be limited to five (5l acre incre- <br />ments. No morn than five acres may be actively engaged in the <br />mining operation at any time. Upon completion of mineral <br />extraction activites upon the five-acre tract, a new five-acre <br />tract may be opened for mining and the prior tract upon which <br />mining operations have coased must be successfully reclaimed <br />prior to moving to a third five-acre tract for mining opera- <br />tions. These five-acre tracts will begin in succession <br />starting on the west side of the property. This succession <br />shall be established and designated on a site plan which must <br />be reviewer: sn;: approved by the Board of County Commissioners <br />prior to any initiation of mining operations on this property. <br />2. All operations other than dust suppression shall cease <br />whenever the wind velocity on site exceeds 35 m.p.h. Wind <br />velocity monitoring devices and records therefrom shall be <br />placed and maintained as required in the site plan review. <br />3. Location oP the proposed access road shall be established <br />at the time of site plan review. <br />4. The operation shall not create noise in excess of 55 <br />d.b.a. at any residential or park boundary in the surrounding <br />area. Monitoring, measurement and record-keeping requirements <br />will be established at the time of site plan review. <br />5. Landscaping, berming and setbacks necessary to screen this <br />operation from Highway 93 and from surrounding residential and <br />park areas shall be required at the time of site plan review. <br />-2- <br />
