The operator would place <br />the cut trees across the slope for erosion control, burying the stumps. <br />Reasoning for Categorical Exclusion <br />My preliminary assessment is that these proposals fall within a category of actions listed in the Forest <br />Service NEPA Handbook (FSH) that are excluded from documentation in an Environmental Assessment <br />(EA) or Environmental Impact Statement (EIS) and there aze no extraordinary circumstances that would <br />preclude use of the Category 8, Section 31.2 of Forest Service Handbook 1909.15. This direction allows for <br />approval of short term (one yeaz or less) mineral, energy or geophysical investigations and their incidental <br />support activities without documentation in an EA. Archeological and biological surface surveys have been <br />conducted for all of the above proposals and no extraordinary circumbstances were identified. These <br />proposals could be categorically excluded for one year. <br />This comment period is intended to provide those interested in or affected by this proposal an opportunity to _ _ _ <br />- - -make theirconcerns ~known'prior to a decision being made. -This comin`enfperiod is being provided pursuant <br />to the July 2, 2005, order issued by the U. S. District Court for the Eastern District of California in Case No. <br />CIV F-03-6386JKS. Those who provide timely and substantive comments will be eligible to appeal the <br />decision pursuant to 36 CFR part 215 regulations. <br />How to Comment and Timeframe <br />Written, facsimile, hand-delivered, oral, and electronic comments concerning these actions will be accepted <br />for 30 calendar days following publication of a notice in the Park County Republican and the Fairplay Flume <br />on February 23, 2007. The publication date in the newspaper of record is the exclusive means for calculating <br />the comment period for this proposal. Those wishing to comment should not rely upon dates or timeframe <br />information provided by any other source. The regulations prohibit extending the length of the comment <br />period. <br />Written comments must be submitted to: Wendy Dobrowolski, South Park Ranger District, Box 219, <br />Fairplay, CO 80440. Telephone 719-836-2031 Fax 719-836-3875. The office business hours for those <br />submitting hand-delivered comments are: 8:00-4:30 Monday through Friday, excluding holidays. Comments <br />may also be made by sending an email message to comments-rocky-mountain-pike-sanisabel- <br />southmarkna,fs.fed.us and including the mining proposal name in the subject line. Acceptable formats for <br />attachments aze MS Word, text or RTF. Each proposal is described individually and will require individual <br />comments. <br />In cases where no identifiable name is attached to a comment, a verification of identity will be required for <br />appeal eligibility. If using an elecfronic message, a scanned signature is one way to provide veri cation.
