Our attorney is working with the Division of Wildlife to <br />address this issue and he is discussing the buffer distance <br />with Mr. Lee Carlson of the US Fish and Wildlife Service <br />{USFWS) regarding the eagle roost. i transferred the roost <br />area to the mining plan map but have not placed a buffer line <br />on the map because the distance has not been agreed upon at <br />this time. USFWS is centering on requiring a one-eighth mile <br />(0.125) buffer, subject to DOW concurrence, around the roost. <br />When the buffer distance is set we will submit a map showing <br />its location. I have enlarged a section of the Mining Plan <br />map showing the roost area and create Adequacy Exhibit 7 for <br />your use. PSt:G is fully aware of their responsibilities <br />regarding threatened and endangered species that may exist on <br />the mine site. No mining will take place inside the buffer <br />during the period Nov 1 to March 1. <br />3. PSSG will do a survey for Burrowing Owls on any area covered <br />with prairie dog holes on the site prior to stripping the <br />land. Be assured they have been aware of this requirement for <br />some time and are committed to surveying for and protecting <br />all possible endangered and threatened species that may exist <br />on this site. Prior to disturbing prairie dog towns between <br />March 1 and October 31 a borrowing owl study will be completed <br />on the area to be disturbed.
