It does appear that PS&G will <br />need to leave an additional 75 foot slough area from what ever <br />prescribed setback they need. I.e. if the setback is 25 feet <br />the total would be 100 feet marked on the ground, if it is 50 <br />feet then 125 feet would have to be left. To avoid a expen- <br />sive drilling program, PS6G could use 60 feet at the depth to <br />shale and not mine within 75 feet of the setback until they <br />know the depth of the deposit. Then if it is shallower than <br />60 feet the limit would be reestablish and mining could move <br />closer to the structure. it is still to PS&G's advantage to <br />acquire an agreement that allows mining close that this limit, <br />so if agreements are reached they will be submitted to the <br />Division. <br />In leu of a signed agreement, Platte Sand & Gravel LLC will <br />commit to establishing the mining limits on the perimeter as <br />mining advance thru a lake area. In each area, the formula <br />used Wlll be: SETHACR DISTANCE + 7S FE6T = DISTANCE TO PRdfECTED STRUCTURE <br />Other Issues <br />39. OSE - A TSSP and well permit to cover their requirements was <br />applied for on March 1, 2001. No mining will expose ground <br />water until these permits are approved. <br />COE - No 404 permit is needed at this time since we will not <br />disturbed wetland areas in the two areas where mining will <br />begin. In the future, PS&G will obtain the necessary permit <br />if one is needed. <br />CHS - Both sites have been located on the maps and PS&G is <br />working with the Platteville Historical Society to protect <br />them. <br />40. Thank you for-the information. i believe the Division has <br />addressed the concerns raised by the objectors, that are <br />pertinent to the state application, in the adequacy review I <br />have addressed with this response. Thank you for the informa- <br />tion on the hearing sequence and requirements. <br />March 8, 2000 Additional Comments Letter <br />1. As stated in item 24 above, PS&G will only do limited <br />dewatering to facilitate placing the dredge in each mining <br />area. There after we will not dewater the excavation area. <br />if, as i explained above, we incorporate dewatering later thru <br />a revision DOW concerns will be addressed. I do not believe <br />the Division or M.L.R.B. can require PS&G to enter into a <br />monitoring program with any of the listed agencies. I feel <br />that the Division has the expertise to administer and review <br />any such program. <br />
