In all cases, more than 100 feet of buffer <br />will be provided between the stream edge and the finished pond in the reclaimed <br />area. <br />Letter dated May 14, 1982 from John Slovek to your office: <br />The area included in the subject application is in a resource conservation <br />area of Weld County. The Weld County Extraction Plan, in accordance with the laws <br />of Colorado, states that extraction shall be encouraged in resource conservation <br />areas as long as appropriate extraction standards are followed. The advertised <br />hearings before the Planning Commission and the Board of Commissioners of Weld <br />County found the application to be in compliance with published application re- <br />quirements. The application before the Mined Land Reclamation Board has been <br />carefully prepared to comply also to the requirements of that Board. The mining <br />operations will not increase the flow of water in St. Vrain Creek during flood <br />periods so no additional damage will result. The operator proposes to reclaim <br />the area in accordance with the application approved by Weld County and as out- <br />lined in the application before the Mined Land Reclamation Board. Phasing of <br />the mining operations will tend to control the magnitude at any one time. <br />The objector, Mr. Slovek, did not appear at the Commissions hearings in <br />Weld County even though those hearings were advertised by posting on the property <br />and in the newspaper. <br />As stated earlier, the operator believes the reclaimed area will actually <br />6e an enhancement to the reclamation and integrity of the stream and surrounding <br />environs. <br />We believe that the issues raised by your letter have been addressed fully <br />herein.
