Backgrotmd consists of an abbreviated synopsis of Land-Use-Department- related events from 1983 thru August 22, 1994. Discussion notes that the Boulder County Zoning Resolution does not state that milling (per se) is a use by right (there is a misstatement implying the contrary in Steven O. Ellis Itr to Mark Steen dated January 9, 1985 -this Itr not included in the present submittal; it is, however, cited by Munn in Item 29); subordinate accessory uses are permitted on a property where a principal use (i.e. mining) occurs. Discussion notes further that Steen gave specific representation of the areas he intended to none (See affidavit, Item t 2 at p 29). These representa- tions were later acknowledged in negotiations with the Frazers on the milling contract, see Item 23 at p 63) Under su-ict interpretation, the Gold Hill Mill would only be allowed to mill ore from the property on which it is located. The interpretation offered, however, would allow the sources of ore represented to the Land Use Department at the time the mill was proposed. The term "ore" should include monzonite, since it may have multiple roles in the milling process, thus cucumventing the purpose of the ore restriction. Staff recommendation is that the appeal be denied.
