Two blank sheets in the packet were not numbered, so total of <br />I IS deviates by 2 from original packet count. <br />Item 1, pp l - 4 Background, discussion and staff recommendation. <br />Backgrotmd consists of an abbreviated synopsis of Land-Use-Department- <br />related events from 1983 thru August 22, 1994. <br />Discussion notes that the Boulder County Zoning Resolution does not state <br />that milling (per se) is a use by right (there is a misstatement implying the <br />contrary in Steven O. Ellis Itr to Mark Steen dated January 9, 1985 -this <br />Itr not included in the present submittal; it is, however, cited by Munn in <br />Item 29); subordinate accessory uses are permitted on a property where a <br />principal use (i.e. mining) occurs. <br />Discussion notes further that Steen gave specific representation of the areas <br />he intended to none (See affidavit, Item t 2 at p 29). These representa- <br />tions were later acknowledged in negotiations with the Frazers on the <br />milling contract, see Item 23 at p 63) Under su-ict interpretation, the Gold <br />Hill Mill would only be allowed to mill ore from the property on which <br />it is located. The interpretation offered, however, would allow the sources <br />of ore represented to the Land Use Department at the time the mill was <br />proposed. <br />The term "ore" should include monzonite, since it may have multiple roles <br />in the milling process, thus cucumventing the purpose of the ore <br />restriction. <br />Staff recommendation is that the appeal be denied. <br />
