None of the chemicals or materials listed in item 13.2 of the application form <br />will be stored within the floodplain. Further, according to recent <br />correspondence with the Division of Minerals and Geology, these chemicals <br />and materials are not identified as corrosives, toxics or hazardous type <br />materials that would require additional review by your office (see attached <br />internal memo documenting a conversation with Allen Sorenson in regards to <br />the above concern). <br />The Applicant may prepare a Spill Prevention Containment and Control Plan <br />if required under the authority of the Weld County or Colorado Public Health <br />Departments. <br />3. The Applicant intends to use fly ash solely as a concrete admixture. The <br />material will be imported from the Laramie River Power Station in Wheatland, <br />Wyoming. It is anticipated that the ash will be stored on site for the duration <br />of concrete hatching operations. Due to changes in supply and demand of <br />the material, the exact amount to be stored on-site will fluctuate. Use of the <br />fly ash will be limited to the area defined as the concrete batch plant site and <br />storage will occur in a steel silo. <br />The fly ash will not be stored in the floodplain nor used for backfill. Because <br />the use of Fly ash in concrete production does not affect reclamation, DMG <br />review of concrete plant operations is limited. The concrete plant is not <br />located within the excavated area, and as an adjunct land use will be <br />reviewed by the Weld County Planning Commission and Board of County <br />Commissioners. <br />4. The Applicant understands its responsibilities under Rule 3.1.5(9). It is <br />anticipated that concrete spoils and other inert materials within the definition <br />of Rule 1.1(20) may be generated subsequent to the commencement of <br />operations at the site. Prior to filling with off-site material, the operator will <br />forvvard the appropriate notices and engineering documentation to the <br />Division. <br />5. The full extent of 404 jurisdiction and mitigation requirements is not known at <br />this time. <br />Groundwater hydrology in this area is generally suitable for wetland <br />establishment; therefore, no special construction techniques were anticipated <br />when DMG maps were produced. If excavation/grading is required to meet <br />Army Corps of Engineers standards, material will be moved on-site only, to <br />the extent necessary to lower planting areas into the groundwater root zone. <br />In other words, no commercial production of construction materials will occur <br />
