Burden of Proof Rea 'cements <br />The permittee has the burden ofproofwhrn seeidng relief from total suspended so]ids ('CSS), total uon, and/or settlceble solids (SS) <br />limitations. Relief rosy be granted separately for each discharge occurrence only when necessary and shall not be granted when the <br />pemtittec has control over the discharge. The permittee should rndeavor ro meet the primary limitations whenever possible. The <br />perniittee will raced ro show that exceedence of theapplicable 1mrimtiona were caused by precipitation and rw other source and that <br />the discharge was beyond their control. Manual dewatering of the ponds shall meet TSS and total iron limitatrons unless it is the only <br />method of dewatering. In such cases, manual dewateriag is eligible for alternate limitations as is auomatic dewatering a~ the <br />following demonstrations shall apply. - <br />a) Por rainfall. [o waive TSS and total iron limitations, it is necessary ro prove that discharge occurred within 48 hours after <br />measurable precipitation has stopped.
