C. 20001 <br />RE: Kerr Coal Company/Federal Lands Program <br />Permit - Application <br />Gentlemen: <br />Kerr Coal Company ("Kerr Coal") is a small, independently held Colorado <br />corporation which is currently conducting surface coal mining operations at a <br />location approximately ten (10) miles east of Walden Ln Jackson County, <br />Colorado. Kerr Coal presently operates an open pit coal mine known as the <br />Marr Strip ill, together with an off mine site load-out facility known as the <br />Marr Prep Plant. All of the operations of Kerr Coal are covered by an Ex- <br />traction and Development Permit, Number 76-13, issued by the Colorado Mined <br />Land Reclamation Board ("MLRB"). This permit was recently amended to effect <br />compliance with the Interim Regulatory Program pursuant to Section 502 of the <br />Surface Mining Control and Reclamation Act ("SMCRA") and the Interim Regula- <br />tions issued in connection therewith (30 CFR Part 770.1 e[ sec.). <br />Accompanying this letter Ss an application for a permit with respect to the <br />Marr Strip Ill and the Marr Prep Plant. The application is specifically <br />directed at compliance with the regulations for the Federal Lands Program <br />pursuant to the Permanent Regulatory Program under SMCRA. The accompanying <br />permit application also is intended to serve as a request for approval of [he <br />mining, plan of Kerr Coal as required by 30 CFR Part 211.10, as well as an <br />application for a permit or permit amendment, as appropriate, from the MLRB <br />pursuant to the recently enacted Colorado Surface Coal Mining Reclamation Act <br />of 1979 (C.R.S. 1973, Section 34-33-101 et seg.).
