2.06.5 Permits Incorporating Variances from Approximate Original
• Contour Restoration Requirements for Steep Slope Mining
Peerless Resources is not requesting a variance from reestablishing the
approximate original contour. However, complete elimination of the
face-up area in conjunction with the continued mining will be
impossible. A complete explanation of the reclamation procedures to be
used to stabilize the face-up area is set forth in Section 2.05.4.
All drainage patterns inherent within the existing area will be restored
following completion of mining activities.
2.06.6 Prime Farmlands
This Section is not applicable to the mining operations planned by
Peerless Resources. Since the negative determination of prime farmland
was arrived at using the eligibility requirements established for prime
• farmland under Section 2.04.12, Prime Farmland Investigation, these
performance standards do not apply to the permit application.
2.06.7 Variances for Delay in Contemporaneous Reclamation
Requirements in Combined Surface and Underground Mining Operations
Peerless Resources does not plan for combined surface and underground
mining operations; therefore, the requirements for this section are not
applicable to Peerless Resources.
2.06.8 Surface Coal Mining and Reclamation on Areas or Adjacent to
Areas Using Alluvial Valley Floors
Both a field investigation and a technical evaluation of the various
drainages containing streams within and adjacent to the permit area have
been conducted. The investigation resulted in no identification of
alluvial valley floors in the area to be mined or the permit area. The
• planned area of mining is in the watershed of Coal Gulch, which is an
ephemeral drainage. Lightner Creek is located north of the mining
2.06-3
