~. ~:. A G
RICHARD D. LAMM
Governor
1328H
Mr. Larry Chattier
21305 County Road 28.5
Brush, CO 80723
Dear Mr. Chattier:
1313 Sherman Street-Room 818
Denver, Colorado 80203
(303)866-3581
October 13, 1983
JERIS A. DANIELSON
State Engineer
This is in further response to your letter questioning whether you can
replace several old gravel pits with one single new pond that has an 'area
which would not exceed the surface area of the combined older ponds.
Based upon the additional information that you have provided to my staff,
tae understand that the following summary table is a correct history of the
older pits:
Surface Area
Pit No.* (Ac.)
1 0.4
2 0.8
3 3.6
4 2.3
5 0.6
6 0.8
Total Area $3
Date Excavated
1952
1953
1948
1951
1953
1955
Date Lakes were filled
in by floodine
1957
1957
1965
1957
1965
1965
* Identification numbers are those shown on your aerial photos.
It is our understanding that Morgan County would remove gravel from the
new pit site for use on county roads and that no water would be used to wash
the material. You have also indicated that water would not be required for
dust control.
Based upon the above information, I would not be opposed to your con-
structing the replacement pond since your proposal would not result in any
change in the historic evaporation losses that occurred when the older pits
existed. My approval is subject to the following conditions:
1. Although the original ponds were filled in by recent floods, you must
agree to have them totally backfilled in such a manner that no water
surface area remains and no water can pond in the location of the
original gravel pit sites.

of cow
R~.-
H~= ~'8
**~*
+876
OFFICE OF THE STATE ENGINEER
DIVISION OF WATER RESOURCES
