• <br />Jul 20 O1 11:59a PRONIR RRNGER DISTRICT 970-527-4151 p.23 <br />S <br />Serial No. C•56447 <br />(REVrSED 3.9.95) <br />CONTROLLED SURFACE US2 STIPULlTION <br />SLOPES 40-fi0t <br />Surface occupancy or use is subject to the following special operating <br />constraints. <br />Special interdisciplinary team analysis and mitigation plans detailing <br />construction and mitigation techniques will be required on areaz with <br />slopes ranging from 40-608, (The interdisciplinary team could include <br />engineering, soil scientist, hydrologist, landscape architect, reclamation <br />specialist and coal mining engineer.) <br />Mitigation may include, but is not limited to, use of erosion control <br />cloths, mats, geoweb soil support materials, lifting and saving local <br />native vegetation in chunks~of sod co be later placed over disturbed areas, <br />reseeding disturbed banks with stabilizing seed mix, use of chemical <br />stabilizers, tackifiers and blankets and careful design of surface water <br />flow. <br />Qn Lands described below: <br />• <br />Portions of Sec. 14, 22, 23 and 26, T_175, R90A, 6th PM with slopes 40-60t <br />as generally delineated on the attached man dated on 3-8-95. The map is <br />for planning ourpos es only. In the event of any conflict betvean written <br />- clauses of this stipulation and the map, the stipulation eiauses shall <br />control. All National Forest system Land within the leasehold which has <br />slopes ranging from 40-608 falls under jurisdiction of this stipulation. <br />For the purpose of: <br />Minimizing potential for soil loss, mass land movement, revegetation <br />failure and unacceptable visual imoairmenc- <br />It may became necessary for a waiver, exception or modification (GEM) to <br />this stipulation for the operator lessee to use the surface in the area <br />covered by this stipulation to alloy for the recovery of the coal reserve. <br />W&`1's co this stipulation will be considered only at the time operations <br />are proposed, and will be subj etc to the Forest Iand and 8asourca <br />Management Plan in effect at the time of consideration, and will be subject <br />to applicable regulatory and environmental compliance requirements. <br />Granting of a NEH is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right to impose other stipulations in the same area of this leasehold if a <br />SIFlf is granted. <br />Arty changes to this stipulation will be made in accordance with the land use <br />plan and/or the regulatory provisions for such changes.
