(The interdisciplinary team could include; <br />geotechnical engineer, soils engineer, roads engineer, coal mining engineer <br />and reclamation specialist.) Attributes constituting moderate geologic <br />hazard include stabilized earthflovs, stabilized mudflovs, stabilized <br />landslides; slopes adjacent to failed slopes or active earthflows, <br />mudflows, or landslides and avalanche chutes; areas of rockfaLl;.and flash <br />flood areas. <br />On lands described below: <br />A11 or portions of Sec. I4, 22, 23, 26, TI3S, R90W,.6~h PM with moderate <br />geologic hazards as generally delineated on the attached map dated on <br />3-8-95. The map is for planning purposes only- The application of the <br />definition of moderate geologic hazard to ground conditions will determine <br />whether the stipulation applies. In the event of any conflict beraeen <br />written clauses of this stipulation and the map, the stipulation clauses <br />shall control. All avational Forest System Land within the leasehold which <br />• .. is classified u having moderate geologic hazards falls under jurisdiction <br />of this stipulation. <br />For the purpose of: <br />To insure the stability of facilities required (such as roads, waterlines, <br />water tanks, powerliaes, ventilation shafts, ancillary buildings, <br />drillpads, etc.) during the coal mining operations and to insure the <br />stability of lands adjacent co these facilities. <br />It may become necessary for a waiver, exception ar modification (WEH) to <br />this stipulation for the operator/lessee to use the surface in the area <br />covered by this stipulation co allow for the reeove.-y of the coal reserve. <br />WEM's to this stipulation will be considered only ac the time operaticns <br />are proposed, and will be subject to the Forest Land and Resource <br />Management Plan in effecc~at the time of consideration, and will ba subject <br />to applicable regulatory and. environmental compliance requirements. <br />Granting of a WEM is a Forest Service discretionary action which the <br />operator should not routinely expect. The Forest Service reserves the <br />right to impose other stipulations in the same area of this Leasehold if a <br />WEM is granted. <br />Any .changes to this stipulation will be made Ln accordance with the land use <br />plan and/os the regulatory provisions for such changes. (For guidance on the <br />use of this stipulation, see HLM Manual 16 Z4 and 3400 or FS Mam~al 1650 and <br />2620.) <br /> <br />
