<br />R.C.R.P.C. <br />STANDARD CONDITIONS: <br /> <br />MINUTES DECEMBER 18, 1997 <br />1. Comply with all applicable conditions of Section 8.3.A (under General Requirements <br />checklist), and Section 8.3.A.3 (Sand and Gravel requirements). <br />2. The Special Use permit is limited to uses and facilities presented in project plan. Any <br />additional uses or facilities must be applied far in a new or amended application. <br />3. Any complaints or concerns which may arise from this operation may be cause for review of <br />the Special Use Permit, at any time, and amendment or addition of conditions, on revocation <br />of the permit if necessary. <br />4. The operator shall prevent the spread of weeds to surrounding lands, and comply with the <br />Undesirable Plant Management Act, adopted in 1990. <br />5. The permittee shall be responsible for any court and attorney fees if Routt County deems it <br />necessary to enforce any of the conditions of the Special Use Permit and is successful in <br />such court action. <br />6. No junk, trash, or inoperative vehicles shall be stored or allowed to remain on the property. <br />7. The Special Use Permit is valid for 10 years provided it is acted upon within one year of <br />approval. <br />8. The operation will be reviewed after the first year of operation and thereafter every two years <br />by Planning Staff with recommendations to PIC and/or BCC as appropriate. <br />9. A maximum of 6 acres shall be mined at a time. Reclamation including grading, topsoiling to <br />a. minimum of 12' in depth, and seeding shall occur concurrently with mineral extraction in <br />each area. The most visible portion of Phase II shall be mined and reclaimed first, to <br />minimize visibility impacts to the neighbors. <br />10. Soil stockpiles shall have a minimum of 3:1 slopes <br />11. No mining shall occur within 50 feet of the drainage, and all crossings shall have a 404 permit <br />in place as well as a County water body setback permit. - <br />12. This permit is contingent upon permits being obtained for air and water emissions, <br />reclamation, and other appropriate permits for all involved agencies. <br />13. All haul roads and disturbed sites shall be watered and chemically stabilized to minimize dust. <br />Water operations shall be increased immediately in response to periods of high wind. <br />14. The permittee shall provide evidence of liability insurance, in the amount of no less than <br />5600,000 per occurrence with either unlimited aggregate or a policy endorsement requiring <br />notice to Routt County of all claims made. Routt County shall be named as an additional <br />insured on the policy. <br />15. The permittee shall apply for and receive a Mined Land Reclamation Board permit and post a <br />reclamation bond with the MLRB prior to commencing any operations. The permittee shall be <br />responsible for reclamation as set forth by the Colorado Division of Minerals and Geology <br />gravel mining guidelines. <br />
