l~
27.It appears that the fences and access roads either partially or wholly owned by Ms. Allen are
within 200 feet of the proposed affected area boundary in several places. Please ensure these
structures are adequately addressed as required by Rule 6.4.19.
The Farmers Ditch damage waiver agreement, supplied with the preliminary adequacy review
response package, does not have a notarized signature from the Farmers Water Development
Company. Please provide a properly executed agreement for this structure.
Please be aware that the 200 foot limit from any structure specified in Rule 1.6.2 and Rule
6.4.19 applies to any mining related disturbance, not just excavation limits. Therefore, no soil
or product stockpiles, mine roads, generators, storage or parking areas, etc. can be located, at
any time, within 200 feet of any permanent man-made structure, for which the requirements
of these Rules have not been satisfied.
DMG is in the process of calculating the reclamation cost estimate for this proposed operation.
The estimate will be finalized upon receipt of your response to this review and will be forwarded
to you at that time.
If you need additional information, please contact me at the Division of Minerals and Geology,
Durango Field Office, 701 Camino Del Rio, Room 125, Durango, Colorado 81301, telephone no.
970-247-5062.
Sincerely,
~~/~
Steve S.
