<br />topsoiling, irrigating and fertilizing can be released. <br />Sufficient bond must be retained to cover the costs of <br />reestablishing revegetation by a third party during t•he <br />remainder of the liability period. <br />a. Phase II Bond Release ADOlication <br />In order for the Division to evaluate t•he success of <br />reclamation for Phase II, the following information is <br />needed in the bond release application. <br />• <br /> <br />i. A map showing the revegetated areas and the reference <br />area. <br />ii. Documentation of successful establishment of <br />revegetation. The Division will accept an adequate <br />sample of vegetation cover frcm each reclaimed area and <br />from the approved reference area. The data sho~~id be <br />presented in a table listing t•he percent ccver by <br />species. Successful est•abl•:shment c•f revegetation will <br />be consi3ered acceptable if the cover of the revegetated <br />area is at least 9C~ of the cover from the reference <br />area with 30~ statistical confidence. Species <br />compo=_ition will be evaluated using t•he species oover to <br />determine whether a diverse ar~3 permanent vececative <br />cover cf the same seasonal variety native to t•he area, <br />as approved in the reclamation elan, is becoming <br />established. <br />iii. Documentation of topsoil replacement• depths. <br />iv. Sufficient evidence that t•he area is net contributing <br />=_uspended solids to =_t•reamflow or runoff outside the <br />permit area is excess of premising levels. <br />As part cf the permit renewal process for the 5dna Mine, <br />the applicant should submit a request for Phase I and Phase <br />II bond release for all areas at the cane which meet the <br />release requirements outlined above. If bond release is <br />not requested, or if none of *.he areas included in the <br />requests can be released, the Division must retain the <br />total bond coverage for the first permit term as well as <br />the additional bond coverage for the worst case disturbance <br />occurring during the second permit term. Bond release <br />requests should be submitted as soon as possible in order <br />to allow the Division an opportunity to inspect the areas <br />and make a decision regarding the requests prior to the <br />permit renewal deadline. Due to the extent of mining which <br />has occurred at the Edna Mine, the Division requests that <br />the applicant prepare a topographic map of the mine which <br />accurately delineates each previously bonded area which has <br />been backfilled and graded and each area which has been <br />topsoiled and seeded.
