• <br />No road construction, maintenance nor bulldozing of any kind has been done by the <br />applicant at the site nor even neaz the site. All access roads present today were <br />previously installed by others. This assertion was confirmed by Divisrox staff in the <br />presence of Doug Conger, representing the applicant, and Clyde Johnson, representing <br />B.L.M., on the Division's site review on November 21, 1997. Any assertions to the <br />contrary by any commentaries must be disregarded as untrue or misinformed. <br />Meanwhile the consideration of the permit application by the Board should not be <br />affected by those proceedings since cultural resources cleazance is jurisdiction of the <br />United States Department of the Interior -Bureau of Land Management and of the State <br />Historical Preservation Office. <br />That issue, we trust you will agree, must not be listed by the informal conference on <br />Tuesday, December 8, 1997, as an appropriate consideration of the Board for permit <br />issuance.
