•
No road construction, maintenance nor bulldozing of any kind has been done by the
applicant at the site nor even neaz the site. All access roads present today were
previously installed by others. This assertion was confirmed by Divisrox staff in the
presence of Doug Conger, representing the applicant, and Clyde Johnson, representing
B.L.M., on the Division's site review on November 21, 1997. Any assertions to the
contrary by any commentaries must be disregarded as untrue or misinformed.
Meanwhile the consideration of the permit application by the Board should not be
affected by those proceedings since cultural resources cleazance is jurisdiction of the
United States Department of the Interior -Bureau of Land Management and of the State
Historical Preservation Office.
That issue, we trust you will agree, must not be listed by the informal conference on
Tuesday, December 8, 1997, as an appropriate consideration of the Board for permit
issuance. We must insist that discussion of that issue at the pre-hearing conference on
January 15, 1997, would unduly prejudice the Board pre•hearing conference officer,
rendering that Board member disqualified to consider the permit at the formal public
hearing scheduled for January 28 - 29, 1997.
You can rely on our proper conduct, and that of the appropriate regulating agencies
regarding the requirements of the Antiquities Act as they apply to this proposed activity.
Sincerely,
STONE GRAVEL PIT
~~
Daren Stone, Proprietor
cc: file, D. Conger
