<br />ENVIRONMENTAL ANALYSIS <br />DENVER OFFICE <br />PUBLIC FILE COPY <br />FILE: ~r-y~-~a9 <br />SITE: sfd ~~ ~,~P p,t <br />PURPOSE AND NEED <br />Daren Stone Gravel Pit <br /> <br />Received <br />Montezuma County, Colorado <br />January 20, 1998 <br />~Ald 2 1 1998 <br />Durango Fisld O'flce <br />Division of F.'inera's 8 Geolopy- <br />Daren Stone, owner of the mineral estate of T. 35 N., R. 17 W., <br />N.M.P.M., Sec. 12: S1/2SE1/4; Sec. 13: N1/2NE1/4, (158.11 acres), <br />has submitted an application for Construction 2•Saterials (112) <br />Reclamation Permit to the Colorado Division of Minerals and <br />Geology (DP1G) for development of private mineral resources <br />located on the parcel. The site is six miles southwest of Cortez <br />in Montezuma County, Colorado. See attached map for location. <br />This parcel was originally patented to private ownership as to <br />both surface and mineral estates in 1893. The surface only was <br />reconveyed to the United States on January 27, 1950, and is <br />managed by the BLM. The dominant mineral estate is privately <br />ou~ned. The United States has only a servient estate. An <br />analysis conducted to recommend appropriate mitigation measures <br />for the proposed surface disturbance incident to the proposed <br />mineral development follows. The decision to approve or deny the <br />permit rests with the DMG, but BLP1 will participate in the <br />process as a surface landowner. The permitting is not a federal <br />undertaking. It is governed by Colorado state law. <br />BACKGROUND <br />On April 25, 1997 Daren Stone applied for a land use permit to <br />explore for sand and gravel on the subject property (he held a <br />contract to purchase the minerals). After review of the facts, <br />it became apparent that no federal permit was required for the <br />proposed action. However, since the surface is federal, <br />notification was required and the application was considered as <br />notice to BLM. <br />On Play 21, 1997 BLM reviewed the existing cultural resource <br />information and recommended that a cultural resource monitor be <br />on hand when the mineral evaluation test pits are dug. A11 <br />cultural sites had been inventoried previously, but an on-site <br />visit to refine the location and identity of the sites was made. <br />On May 27, a review of records and biological files was conducted <br />to determine the presence of any federally listed Threatened, <br />Endangered & BLP1 sensitive Species. Based on this review, no <br />listed species were expected to be found on this site. On June <br />1 <br />
