<br />Please indicate whether this issue has been addressed and supply a copy of the permit application if <br />the permit is necessary. <br />Rule 6.3.12 Exhibit L- Permanent Man-Made Swctures <br />5. Exhibit L is defined as Permanent Man-Made Structures. Exhibit L states that where permanent, <br />man made structures exist within 200 feet of the affected land, the applicant must submit either: a <br />notarized compensatory agreement between the applicant and the person(s) having an interest in the <br />structure; or an appropriate engineering evaluation that demonstrates that such structure shall not be <br />damaged by activities occurring at the mining operation. The map and text of the permit application <br />indicate that a road and an irrigation ditch are situated within 200 feet of the permit area. Please <br />submit agreements with persons having an interest in the structures, or engineering evaluations <br />demonstrating that the proposed mine plan will be protective of the structures. In the absence of <br />either of these exhibits, and in the interest of approval of the permit in a timely manner, a statement <br />committing that mining will not occur within 200 feet of these structures prior to obtaining one of <br />the above documents can be submitted. <br />Please be advised that the Piceance Pi[ New 110 Permit Application may be deemed inadequate, and the <br />application may be denied on August 29, 2001 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division. If you feel more time is needed to complete your reply, the <br />Division can grant an extension to the decision date. This will be done upon receipt of a written waiver <br />of your right to a decision by August 29, 2001 and request for additional time.
