EXHIBIT D MINING PLAN <br /> LEGAL DESCRIPTION; Section 14, Township 7 North, Range 46 West, except the SW <br /> 1/4 of Section 14. <br /> The mining operation at the Sunny Dale Farm Pit will commence as soon as a permit <br /> is granted by Mined Land Reclamation Board . This could be anywhere from August <br /> 21 to September 5, 1998, barring any complications, but immediately upon approval <br /> from all agencies and obtaining the required amount of bond in the form of a surety <br /> bond. The mining process should end in approximately ten years from <br /> commencement, or the fall of 2008. The creek is the South Fork of the Frenchman <br /> Creek and is part of the Frenchman drainage. The affected area in the stream <br /> channel is a dry creek bed and the only water present is for a short period after rainfall. <br /> The access area to the pit site off of County Road 22 will first be angled to <br /> accommodate trucks turning in off the road. The fence will be angled in a <br /> southeasterly direction at a width of approximately 20 feet and if cattle are present <br /> during extraction, a cattle guard will be placed at the entrance. The primary access <br /> road will be improved with road surfacing gravel at a width of 20 feet where necessary. <br /> The estimated depth of the soil suitable for plant growth medium will be from 2 inches <br /> to 18 inches on the north bank area. There is no overburden in the creek stream bed <br /> and approximately 2 inches in areas where topsoil has washed over parts of the outer <br /> portion of the bed and vegetation is extremely sparse. Topsoil will be stockpiled at the <br /> north end of the affected area (EXHIBIT E) far enough removed from the potential flow <br /> of the creek so if heavy rainfall did make the creek run, it would not encounter the stock <br /> piles. The stockpiles will be stabilized with a cover of vegetation until used in <br /> reclamation. They will be located separate from other stockpiles, to the north of mine <br /> traffic, and out of the stream channel. Some will be placed on the south side of the <br /> mining operation. Reclamation will be done in 3 acre increments as mining an area <br /> that size is completed, and mining will continue to the west. With the exception of the <br /> bank areas, we expect to mine approximately 3 acres per year. <br /> We anticipate approximately 3 foot to 4 foot of gravel to be excavated from the stream <br /> bed and from approximately 4 feet to 10 feet in areas on the north where extraction <br /> goes into the bank. The bank area (approximately 2.9 acres) at the east end will take <br /> approximately 2 years to extract the gravel if we have a correct anticipation of the <br /> amount there. At the same time this bank is being mined, we will begin extracting <br /> gravel from the channel enough to direct the flow of any runoff from heavy rainfall <br /> away from the site where the overburden has been removed. <br /> EXHIBIT D MINING PLAN NARRATIVE <br />
