<br />3. We have clarified that sand spoils from the site will be <br />utilized with any backfilling and there will be no import <br />of sand spoils material fro:r. off site. We previously had <br />specified that if clean filling is ever undertaken, a <br />Certificate of Designation will be obtained. <br />4. Cooley believes that the State Water Quality Division <br />will allow them to amend their existing discharge permit <br />to include this property, and if necessary, to change the <br />discharge points. However, we have made it clear, that <br />the appropriate amendments will be obtained and if this <br />isn't allowed, a new discharge permit will be obtained <br />prior to any discharge. <br />5. We have added details on the slurry wall installation and <br />added another letter from Matrix addressing the lack of <br />impact on adjacent structures caused by the slurry wall <br />installation. <br />6. We have changed our sloping requirement to state that all <br />final slopes will be a minimum of 3 to 1. <br />7. We have committed to the recommendations on subsoiling, <br />mulching, etc. as outlined in Exhibit I and J. <br />8. We have added some language on methods of backfilling, <br />and specified that erosive wave action will be an on <br />going maintenance item, when the reservoir is filled and <br />utilized for water storage. <br />9. The channel improvement area has been made Area 2A. This <br />area will be improved at one time, probably with or after <br />mining commences on Area 1. we have also added a <br />restriction that no mining will occur in this area until <br />all of these improvements are installed. We don't feel <br />any additional bond among is necessary, since the bond <br />calculations included reclamation activities in this area <br />as the worst case scenario anyway. <br />10. The bond costs have been recalculated to include the So <br />forfeiture charge. In addition, some minor changes were <br />also made to reflect the 3 to 1 slope to the depth of the <br />reservoir and the additional tree seedlings. The total <br />amount is now proposed as $744,000. <br />Exhibit M <br />We've Clearly stated that a gravel well permit will be <br />applied for prior to initiation of any ground water use <br />or exposure. <br />
