The clay material used to create the final <br />reservoir reclaimed sideslopes is excavated from the bottom of the mining area. The reclamation cost <br />estimate for the volume of material needed to create the reservoir side slopes (as shown in the detail on the <br />Reclamation Plan Map) can be calculated based on the known toe of mining slope. We previously provided <br />the Division with an estimated volume of material required to create 6,000 linear feet of clay slope liner, as <br />consistent with the condition that no more the 6,000 linear feet of slope liner would be incomplete. <br />Rule 6.4.7 Exhibit G- Water Information <br />11, Please respond to the Division's hydrology review comments for the Lupton Lakes Resource <br />application sent to you on Apri18, 2005. <br />Please see the attached letter to Tom Schreiner as we have responded to these comments under separate <br />cover. <br />Rule 6.4.19 Exhibit S-Permanent Man-Made Structures <br />12. previous question ti41) Please provide consent to relocate for the gas line associated with the <br />Adams property as previously requested. <br />The agreement will be forwarded to the Division by Bob Bruce, attorney for SW TKO. <br />13. Please respond to the CDOT letter dated March 26, 2005 (sent by separate cover on March 28, <br />2005) regarding issues regarding US Highway 85. Attached is the letter for your convenience. <br />Our response to the CDOT letter is attached. <br />14. Please clarify the mining set back distance for the following locations on Exhibit 3 of 7; <br />• Wesf side of Pond 1 state the mining setbacks from toe of slope <br />• North side of Pond 1 state the mining setbacks h'om toe of slope <br />• Southwest side of Pond 2 state the mining setbacks horn toe of slope to the existing gas <br />well <br />• Pond 2 state the mining setbacks from toe of slope to the existing gas lines <br />• In area 15 of Pond 2 state the mining setbacks from toe of slope. <br />Please refer to the mining plan map for the requested clarifications. <br />15. Topsoil and overburden piles will need to be placed so they are not affected by the mining plan. <br />In particular the east topsoil pile in pond 2 and the southwest piles in pond 2. Please further describe <br />how the topsoil and overburden piles will not be affected by the mining operation. <br />The topsoil and overburden piles have been placed so that they are not affected by the mining plan. In <br />particular the stockpiles that are in the processing area have been placed to help screen the operation from <br />Weld County Road 27 and to help modulate the noise levels leaving the site. These stockpiles will be <br />removed when the processing area is removed from sections 17 and 18 so that these areas can be mined <br />and reclaimed. We have added a note on the mining plan map denoting this. <br />
