Ms. Erica Crosby, Division of Minerals and Geology <br />April 15, 2005 <br />Page 3 of 5 <br />~~ <br />CIVIL RES AURCES,LLC <br />If the operator wishes to account for salvage value of structures on site then the operator may <br />include salvage credit for the salvage value ofproject-related fixtures and equipment owned by the <br />operator. The operator wilt need to address the Rules of 4.3.9, 4.9.3 and 4.12 that address salvage <br />value and first priority liens on fixtures and equipment. <br />In order to resolve this issue, the applicant has the following options; <br />• If the operator wishes to account for salvage value of structures on site, the operator may <br />include salvage credit for the salvage value ofproject-related fixtures and equipment owned by the <br />operator. The operator will need to address all of the requirements of Rules 4.3.9, Rule 4.9.3, Rule <br />4.12 whereas a financial wananty based on salvage credit meet specific requirements, OR <br />• Provide the Division with the dimensions of structures on site to be included in the reclamation <br />cost estimate. If the applicant does not agree with the reclamation cost estimate then the applicant <br />can appeal this decision in writing to the Mined Land Reclamation 8oa~d (MLRBj. The MLRB will <br />make a determination if such structures should or should not be included in the reclamation cost <br />estimate. <br />The recycling plant, the concrete batch plant, asphalt plants, scale house and scale are all portable. These <br />are typically transported from site-to-site by the operator as one site ceases operation and another begins. <br />These structures do require concrete pads for stability. Quantities for materials were previously provided to <br />the Division. The approximate dimensions you requested are as follows: <br />Concrete Batch Plant approximately 30' x 50' <br />Portable Mobile Scale House -approximately 8' x 20 ' <br />Portable Scale -approximately 10' x 60' <br />Portable Recycling Plant -equipment on concrete pad <br />Portable Premier Asphalt Batch Plant -this is equipment on a concrete pad. Equipment includes a small <br />control house (approximately 100 sf), silos, and conveyors. <br />Portable Secondary Asphalt Plant -this is equipment on a concrete pad. Equipment includes a small control <br />house (approximately 100 sf), silos, and conveyors. <br />9. (previous question #18) Please forward the agreement between SW TKO and Ken-McGee to <br />relocate the gas line and associated facilities in phase 12 of the mining plan. <br />The agreement will be forwarded to the Division by Bob Bruce, attorney for SW TKO. <br />Rule 6.4.6 F~rhibit F- Reclamation Plan Map <br />10. The applicant states that a map with the proposed contours of the final reclamation will be <br />submitted at a later date with the technical revision that contains the construction plans and <br />specification for the compacted clay liner. The Division request that approximate contour elevation <br />be included on the map to determine the overall pit depth upon final reclamation. This information is <br />required in order to calculate the reclamation cost estimate for the site. The applicant may revise the <br />contour intervals at a later time if needed with the construction plans and specifications for the <br />compacted clay liner. Please include the contour intervals on the reclamation plan map as previously <br />requested. <br />
