Is the data on existing vegetation also valid for Areas B and C? <br />If you are not sure, ask the S.C.S. <br />Exhibit L <br />1. The on]y reclamation cost data given so far come from the S.C.S. <br />and indicate reclamation costs of $1,693.50/acre. If this is multiplied <br />by 83 acres, it gives a total financial warranty of $140,560.50. <br />`' Although the per acre cost for reclamation of major disturbance seems <br />J~ reasonable, staging of operations and the use of major, moderate, and <br />J `minor disturbance classifications could reduce the total required <br />financial warranty. Please clarify this matter. <br />Exhibit M <br />1. Please verify that the zoning approval from Eloert County for the <br />original 56.13-acre operation as given to the Millers is valid for Terra <br />Construction Company's 8:1-acre operation. <br />Exhibit N <br />1. Is a fugitive dust permit needed from the Co]orado Department of <br />Healthl If so, please send a copy of the permit or the application for <br />it. <br />Exhibits 0 and P <br />1. The owners of areas A, B and C of the permit area should be listed, <br />1 and Terra Construction Company's legal right to enter all three should be <br />\ given (copy of deed, lease, etc. or a sworn affidavit from Terra that all <br />83 acres can be entered upon for mining operations). <br />I discussed your plans for removal of surface rocks or pasture land for <br />use as an aggregate source with our Division Director, Dave Shelton. He <br />agrees with me that such an operation should not be considered mining (as <br />defined by our Act}, and the question will not need to go to our Board <br />for a determination. I hope that this clarifies the Division's position <br />on this matter.
