Pueblo County P1aTining Commission <br />Re: Special Use Permit No. 709 <br />September 4, 1992 <br />Page 3 <br />Prior to any washing of gravel on this site, the applicant <br />shall provide to the Department of Planning and Development <br />proof of legal documentation regarding the water source <br />and discharge (i.e. , well permit, NPDES, etc.) . <br />The applicant shall provide a fugitive dust emission control <br />program on 36th Lare between South Road and the access road <br />intersecting at the entrance to the applicant's property. <br />The program may include, but is not limited to, water <br />application and chemical palliative application to the <br />roadway's surface. <br />10. The applicant's haul trucks shall not operate on the haul <br />route (see Condition No. 4) between 7:30 a.m. and 8:30 a.m <br />during school days. This condition applies to the truck <br />independent of whether they are empty or loaded. This <br />condition does not provide for the use of a secondary or <br />alternate haul route to be used. <br />11. Special Use Permit No. 709 shall be placed on a one-year <br />review. <br />Staff spoke with Robert Cochran, Broderick and Gibbons, on September <br />10, 1992 and he indicated that, to date, no extraction had taken place on <br />the site. However, Broderick and Gibbons does have plans to extract <br />gravel from the site in the future so they wish to continue the special <br />use permit. <br />MLRB PERMIT <br />The operator obtained a 112 Mined Land Reclamation permit, number <br />M-90-112 on January 7, 1991. The 112 permit does not restrict the <br />acreage that can be disturbed or the tonnage that can be excavated. <br />ACCESS <br />Access tc the site will be on U.S. 50 through Vineland and south along <br />36th Laney to the site. Materials mined and processed on the site will be <br />hauled b}~ truck to Broderick and Gibbons' main yard in Pueblo for final <br />processing and incorporation into the various products the company <br />produces (Exhibit 2). No other routes will be taken from the main yard <br />to this site. The applicant projected an average of 30 to 40 trucks per <br />day depending on the demand for the materials. As of September 10, <br />1992, the applicant had not obtained a completed access permit. <br />LAND US:5 AND ZONING <br />The site is currently rangeland and located in an A-1, Agricultural <br />(minimum 40 acres), and a S-1, Public Use, Zone Districts. <br />
