The following questions and comments on the adequacy of the <br />proposal are organized according to the format of the application. <br />Legal Description - Exhibit A <br />1. The permit area given on the application form is 1302 acres. The permit <br />area described in Exhibi"t A is 1306.22 acres. Which is correct? Please <br />verify that the legal description in Exhibit A is correct. <br />2. Please provide documentation on agreements with the railroad to utilize <br />their right-of-way for constructing the access road crossing and railroad <br />spur connection when these become available. <br />Mine Plan - Exhibit D <br />3, Both the concrete plant and asphalt plant areas of six (6) acres each are <br />shown on Exhibit C. The plan says it is unlikely that both would exist <br />at the same time, and only one area was proposed in the reclamation cost <br />estimate (Exhibit L), As only one area is proposed for approval, if in <br />the future both are needed, a technical revision of the mine plan will be <br />required. <br />4. What will be the minimum distance (height) between the depth of <br />excavation and the bottom of Lone Tree Creek along the entire <br />longitudinal profile of the creek in the area of the mine?
