Comments indicating an absence of water rights for the proposed operation. <br />The application indicates that a well permit for evaporative loss and/or use of exposed <br />groundwater will be acquired from the Division of Water Resources, and that a substitute <br />water supply plan will be acquired if necessary. The application indicates that sufficient <br />water rights are available for the appropriate permits. <br />22. Comments relating to revegetation of affected lands. <br />The application specifies that affected lands will be revegetated to support pastureland <br />and developed water resources post mining land use. The revegetation plan indicates that <br />topsoil will be replaced at approximately 1' depth and seeded with Meadow brome grass, <br />Intermediate wheatgrass, Orchardgrass, Timothy, and Cicer milk vetch. Revegetation will <br />include mulch and fertilizer, as necessary. Pursuant to Rule 3.1.10(1), affected areas <br />located above the anticipated water line will be revegetated in such a way as to establish <br />a diverse, effective, and long-lasting vegetative cover that is capable of self-regeneration <br />without continued dependence on irrigation, soil amendments or fertilizer, and is at least <br />equal in extent of cover to the natural vegetation of the surrounding area. The <br />revegetation plan proposed by the applicant appears capable of satisfying the <br />performance standards of Rule 3.1.10, and satisfies the minimum requirements of the Act <br />and Rules. <br />23. Comments relating to weed contro% <br />The application acknowledges that apre-existing weed infestation exists and commits to <br />the weed contro4 methods recommended by the NRCS. Additionally, the operator is <br />required to employ weed control methods for all prohibited noxious weed species,. and <br />whenever invasion of a reclaimed area by other weed species seriously threatens the <br />continued development of the desired vegetation. Weed control methods shall also be <br />used whenever the inhabitation of the reclaimed area by weeds threaten further spread of <br />serious weed pests to nearby areas, as required by Rule 3.1.1016). <br />24, Comments relating fo the wildlife statement in the application and the <br />absence of selected species of wildlife from the wildlife statement. <br />DMG has reviewed the wildlife statement provided in the application and has determined <br />that it satisfies the minimum requirements of Rule 6.4.8 and demonstrates compliance <br />with the applicable requirements of Rule 3.1.8.
