<br /> <br />In the estimate for the "Moderate Disturbance" category, please <br />discuss how this will develop over the life of the initial 180-acre <br />parcel. For example, as mining advances outward from the original <br />60-acre area, the acreage attributed to roads and sediment control <br />berms would increase. <br />Please also address at what times during the life of the mining and <br />reclamation that financial warranty release inspections would be <br />requested. We would recommend that inspections of reclaimed areas <br />be considered requested at least two years before areas beyond the <br />original 180-acre parcel are disturbed. This would allow ample <br />time for the Division to schedule the inspection and the operator <br />to address any necessary site corrective actions required. <br />The Division realizes that due to randomness of the deposit and <br />variable future product demand, mining and reclamation might <br />accelerate or decelerate significantly. We must however be <br />adequately assured that no disturbance of unbonded acreage will <br />occur without the operation having either an equal area reclaimed, <br />inspected and released, or the bond raised to cover the new area of <br />disturbance. <br />3. How will the Affected Lands boundary be marked in the field? This <br />is of special concern along the southern boundary, where mining <br />will occur on the flanks of the three small hills. This is also of <br />concern along the west Affected Lands boundary as it does not <br />coincide with the permit boundary. <br />4. Please provide an estimate of the volume of water that will be <br />required on an annual basis for all mining and reclamation <br />operations. Please indicate all water rights and sources of water <br />necessary to supply the project water requirements (See Rule <br />2.1 .2 (8) ). <br />!i. The operator should commit to the reseeding proposals outlined in <br />Exhibit E, namely: <br />a. If seed will be broadcast, the proposed broadcast mix will be <br />used and seeding will occur between February 1 and April 30. <br />b. If seed will be drilled, the proposed drill mix will be used <br />and seeding will occur between February 1 and April 30. <br />c. if seeding occurs more titan 14 days after the last recommended <br />seeding date, then mulching with 2,000 pound of weed-free straw <br />per acre and fertilizing with 30 pounds of nitrogen per acre <br />will occur. An alternative to mulching and fertilizing would <br />be double seeding. <br />
