Based on the proposal of 15 acres for the <br />plant/processing site, it would appear that the remaining 45 acres <br />of the proposed initial 60-acre bonded area could be mined in two <br />years. <br />It would appear that two more sixty-acre parcels should be bonded <br />for during operations. This is necessary due to the length of time <br />required for revegetation of the reclaimed area. It is unlikely by <br />the time the third sixty-acre parcel begins operation that the <br />regraded and reseeded areas of the first sixty acres will have met <br />the statutory standard set forth in Section 34-32-116(7)(e), which <br />states: <br />"In those areas where revegetation is part of the reclamation <br />plan, land shall be revegetated in such a way as to establish <br />a diverse, effective, and long-lasting vegetative cover that <br />is capable of self-regeneration and at least equal in extent <br />of cover to the natural vegetation of the surrounding area." <br />Therefore, please redescribe the mining operation in terms of <br />acreage according to the three disturbance categories outlined in <br />Rule 2.1 .2(5)(d). Please provide a maximum "Major Disturbance" <br />acreage, as this will be a significant factor in the Division s <br />financial warranty estimates. <br />
