Box 17583, Terminal Annex <br />Denver, Cobrstlo 80217 <br />7ekphone 303.753-8600 <br />December 15, 1980 <br />Northern <br />Coal <br />Company <br />Mr. Jim Herron <br />Colorado Div, of Mined Land Reclamation <br />723 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />RE: Placement of Fill on Northern No. 1 Mine Refuse Disposal Area <br />(CMLR Permit Number 79-9) <br />Dear Jim: <br />Pursuant to our conversation of December 12, 1980, I am sending <br />you this letter to clarify the steps that Northern Coal Company <br />will take to prepare filled areas of the refuse disposal pile <br />for revegetation. After the spoil has been properly compacted, <br />three feet of clean fill obtained from areas within the refuse <br />disposal area to be disturbed for future spoil dumping, will <br />be placed over Phase I spoil. Then, approximately 12 inches <br />of topsoil will be placed on top of the now covered refuse <br />layers in accordance with State and Federal regulations. <br />Northern Coal Company requests that CMLR consider an experimental <br />practices program for Phase I of the refuse disposal area. <br />Northern Coal Company would like to experiment with clean fill <br />cover plots of two feet and one foot plots, to be covered by <br />approximately 12 inches of topsoil. Water samples would be <br />taken once per year for a period of five years to determine if <br />any toxic substances are leaching to the surface. If no discer- <br />nible differences in water/soil chemistry are apparent for fill <br />coverings of less than three feet, Northern Coal Company would <br />request a deviation from the requirement that four feet of non- <br />acidic and non-toxic overburden be placed over the spoil material. <br />Until such time as an experimental practices program can be for- <br />mulated by Northern Coal Company and approved by CMLR, Northern <br />Coal Company will place three feet of clean fill over all spoil <br />placed in the refuse disposal area. <br />If you have any questions, please do not hesitate to contact me. <br />Sincerely, <br />NORTHER/NIICOAL COMPANY <br />(/~'• <br />TG7~W.
