Long <br />Drv6ion D~reaor <br />Listed below are adequacy review comments on the Ft. Lupton Sand and Gravel Mine New 112 <br />Application, Permit Number M-99-120. The Division of Minerals and Geology (Division) is <br />required to make an approval or denial decision no later than March 27, 2000, therefore, your <br />response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />I . As required by Rule 1.6.2 (I)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper, all owners of record of surface lands, easement holders, and <br />owners of record of surface lands that are within 200 feet of the boundary of the affected land. <br />Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.43 Exhibit C- Pre-mining and Mining Plan Maa(sl of Affected Lands <br />2. Rule 6.4.3(8) requires the applicant to show the owner's name of all structures on the affected <br />land and within 200 feet of the affected land. Rule 1.1(48) defines "Structure. Significant, <br />Valuable and Perrnanent Man-made" as anon-portable improvement to real property which has <br />defined, current and recognizable value of an economic nature; generally including but not <br />limiting to: buildings, houses, barns, fences, above or below ground utilities, irrigation ditches, <br />maintained or public roads, bridges, railroad tracks, etc. Please indicate the owner(s) of all noted <br />structures on site and within 200 feet of the affected land. <br />Rule 6.4.4 Exhibit D-Mining Plan <br />3. The applicant states that after mining is complete, the excavated area will be reclaimed as two <br />water storage reservoirs surrounded by an engineered impermeable bentonite slurry wall. The <br />applicant will need to provide engineering designs of the slurry wall including a map of the <br />location, a cross section depicting the slurry wall width and depth, construction methods (how it <br />will be keyed into bedrock, material type and percent bentonite) and quality assurance.
