The decision date for the above referenced application has been extended, by applicant request,
to February 11, 2005. Thank you for the extension request. Please be advised that the application
may be deemed inadequate, and may be denied on February 11, 2005 unless the following
adequacy review items are addressed to the satisfaction of the Division.
Exhibit C, Mining Plan Map, shows the locations of topsoil and overburden stockpiles for
Phase 1 only. Please indicate, either by written description or on the Mine Plan Map,
where reclamation materials will be stockpiled for each of the mining phases. Such
information is critical for determining the cost of reclamation.
2, Pursuant to Rule 6.4.4(f)(ii), please identify the stratum immediately beneath the material
to be mined.
3, Pursuant to Rule 6.4.4(i), please specify whether explosives will be utilized and if so,
provide a Geotechnical Stability Exhibit, per Rule 6.5(4), demonstrating that the fence
lines, county roads, gas well and buried gas lines within the permit boundary and within
200 feet of the permit boundary will not be adversely affected by blasting.
4, Pursuant to Rules 6.4.5(1), (2)(d) and (2)(f)(v), please provide the depth or range of
depths for overburden and topsoil replacement.
5. Pursuant to Rule 6.4.7(5), please clarify whether a NPDES permit from the WQCD is
necessary.
6. Pursuant to Rule 6.4.10(1)(c), please estimate the carrying capacity for of the affected
land.
Pursuant to Rule 6.4.12(2), please clarify the maximum slope of the active highwall
during mining operations, and the method of highwall reduction to be utilized during
reclamation. As noted under item 1 above, please clarify the location of reclamation
