Lamm <br />Governor <br />March 18, 1985 <br />Mr. Fred Schmalz <br />Schmalz Construction, Ltd. <br />719 South Blvd. <br />Box 1105 <br />Gunnison, Colorado 81230 I <br />Re: Schmalz Construction, Ltd. - "Hollenbeck Pit" -File No. M-~5-023 ~ <br />Gunnison County - "Hollenbeck Pit" - File No. M-84-153 <br />Dear Mr. Schmalz: <br />I have completed my adequacy review of the limited impact permit a plication <br />for the Hollenbeck Pit and have several questions and comments tha are <br />organized on an exhibit-by-exhibit basis below. Any exhibits or p rt thereof <br />not mentioned are considered adequate for Board approval now. Ple se respond <br />to this letter at your earliest convenience, but certainly by no 1 ter than <br />March 25, 1985. In this way, I will be able to review your respon es and <br />comments as necessary. If we can resolve the various issues rail d in this <br />letter, this matter should be able to be considered as a "no probl m" matter <br />and be presented to the Board in a written format during the upcom ng <br />March 27-28, 1985 meeting. Thus, your presence would not be requi ed at that <br />meeting. <br />Before the Board can consider this application, we must receive pr of of the <br />two sequential weeks of publication (publisher's affidavit or a co y therof) <br />and the proof of notifications to the landowner of the permit area and to all <br />immediately adjacent landowners (certified mail green or white rec ipts). <br />Please submit these items to us as soon as they are available. <br />As I understand it, the 9.9-acre permit area of your application i to <br />entirely overlap the 5-acre permit area presently permitted to Gun ison County <br />u as a 111 operation. Two items should be made clear in this regard First, it <br />J should be made clear, perhaps with one map that overlays the two p rmit areas, <br />that the new 110 permit area totally contains the smaller, 111 are Second, <br />to avoid the possibility of two permits on the same site, I will n ed to get a <br />2 request from Gunnison County for a release of reclamation responsi ility for <br />their permit area because your company is repermitting.the same si e. I will <br />then schedule the release of their reclamation responsibility for heir <br />"Hollenbeck Pit" during the same March 27-28, 1985 Board meeting. <br />Exhibits B and C <br />1. If possible, further detail on the type of asphalt plant to be fused should <br />be given.
