RE: Yocam Pit (File M-99-060) Adequacy review of permit application
Dear Mr. Lucero:
The Division has conducted an adequacy review of the above referenced application and has identified the
following concerns:
PAGE 6 OF APPLICATION: You have signed the application on behalf of Las Animas County but you
are not designated on Page 3 of [he application as the Applicant /Operator but only as the Permitting Contact.
Please provide a letter from the ApplicandOperator indicatins that you have the authority to sign [he
application on behalf of the County.
EXHIBIT C, Section (f): You have not specified the dimensions of the excavated pit which appears, from
the Exhibit E-Mining Plan Map, as possibly extending over the entire proposed permit area from the area of the
stockpiles south east to the limits of the permit area.
Please confirm that [he area to be excavated is as stated above or provide the dimensions of the pit to be
excavated and an appropriately revised Exhibit E-Mining Plan Map.
EXHIBIT C, Section (j ): You have stated that Colorado water laws or existing water rights will not be
affected by this operation. Under Exhibit C, Section (i), however, you indicate you will contain excessive runoff
within [he pit area which the Division believes might conflict with the requirements of State Statutes administered
by the State Engineer's Office. In Exhibit F, you do not indicate any contact with the State Engineer's Office.
Please indicate if any contact with [he State Engineer's Office was had in regard to your planned retention
of storm water runoff on site and the result of [hat contact.
EXHIBIT D, Section (v): This section requests information in regard to any need for mulching in
conjunction with the revegetation of the site and, if mulching is needed, what would be planned. Nothing in the
Exhibit or in the included NRCS seeding plan speaks to consideration of this section of the Exhibit.
Please indicate if there is a need For mulching and, if so, what kind, the crimping method and the rate of
application.
EXHIBIT D, Section (vi): This section requests information on the establishment of shrubs andlor trees.
Nothing in the Exhibit speaks [o this or to consideration of this requirement.
Please indicate if there is the invention to establish any shrubs or trees as part of the reclamation plan and,
if so. please indicate the species and number to be established per acre.
