Lessee agrees that Lessee shall be liable and agrees to pay for all <br />damages to the surface of the land, livestock, growing crops, or improvements caused by <br />Lessee's operations on the leased premises or adjacent property. <br />~ILITY: <br />Lessee shall inder»nify Lessor egaulst all liability and loss and against all claims and <br />actions of any kind, including the defense of such claims or actions teased upon or arising out of <br />damage or injury including death, to persons or property caused by or sustained in cormection <br />with this kale by conditions created thereby or by any operations of the I,essec, Lessee's agents, <br />empbyees, or subcoatraaors or based upon any violation of ally statute, ordirtarlcc or regulation. <br />In that regard, the Lcssec shall maintain throughout the term of this agreement, a public <br />Liability ituurance policy ttattting Lessor as additional insured with mirmnum sDagk limits of One <br />Million and 00/100 Ibllars (51,000,000.00). Suclt polity shall requve notice to Lessor of <br />cancellation at kart thirty (30) days prior to airy cancellation date. Failure to maintain such <br />insurance shall be deemed a default ofthe terms ofthis Lease. <br />W ATF,R <br />It is agreed that Lessor sha12 make available a supply of water to Luce front water wells <br />ofthe Lessor. Lessee shall pay arty expense incurred for extending pipelines Gem the current <br />water system to the site of use by Lessee upon ills Iwsed premises. Lessee shall pay any and all <br />expenses incurred by Lessor m arranging for such ware use, including the water augmentation <br />P~ P'P~ P~>P~ pumping rnsts, valves, pertitits, any legal costs incurred in obtaining the same <br />and the costs of convwction, installation and operation. Lessor agrees to cooperate and to <br />supply water out of Lessor's water authorization. <br />IN5PECTON: <br />'I1re Lessor shall, at all reasottabk times, have the right of full access to the premises for <br />the purpose of inspection oftha saarc, including the tight to inspect all records, permits, arld <br />reports utilized is the operation of the same. In that regard, the parties understand and agree that <br />Lessor may make such inspection in person or by his representative, designated in writing by <br />Lessor throughout the term of this Lease. <br />
