• COMPLIANCE INFORMATION <br />Pursuant to Rule 2.3.5(3) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the attached is a listing of each <br />violation notice received by HGTI, Permit No. C-92-081, for the period <br />November 23, 1999 to November 20, 2002 for violations of a provision of the <br />Act, or any law rule or regulation of the United States, or any State law, <br />rule or regulation enacted pursuant to Federal law, rule or regulation <br />pertaining to air or water environmental protection incurred in connection <br />with any surface coal mining operation. A list of al unabated cessation <br />orders and unabated air and water quality violation notices received <br />between November 23, 1999 and November 20, 2002 by any surface coal mining <br />and reclamation operation owned or controlled by either HGTI or by any <br />operation is the HGTI - Peabody Energy Corporation Organization Family Tree <br />is also included. <br />For each violation notice or cessation order reported, the list includes <br />the following information: <br />.• 1. Company name, mine name, any identifying numbers for the operation, <br />including the Federal or State permit number and MSHA number and <br />location by State; <br />2. The date of issuance of the violation notice and the name of the issuing <br />regulatory authority, department or agency; <br />3. A brief description of the particular violation alleged in the notice; <br />9. The date, location and type of any administrative or judicial proceeding <br />initiated by the applicant to obtain administrative or judicial review <br />of the violations. <br />5. The current status of the proceedings and of the violation notice; and, <br />6. The final resolution of any notice of violation. <br />It should be noted that the attached represents a complete listing of the <br />above-described violation notices or cessation orders and their status as <br />reflected by the Office of the General Counsel of Peabody Holding Company, <br />Inc., 701 N. Market Street, Suite 700, St. Louis, Missouri, 63101-1824 as <br />of November 20, 2002. Applicant reserves the right to supplement this <br />listing to reflect any information received by the Office of the General <br />Counsel after said date. <br />1 Revised 3/20/03 <br />
