That said Special Use Permit shall only remain in full <br />force and effect so lone as a valid and existing lease between <br />applicant and :Jnion Pacific Railroad Company regarding the <br />above-referenced tract remains in Cull force and effect. <br />?. In accordance with applicant's testimony, operations on <br />the above-referenced tract shall occur only during daylight <br />hours. <br />3. All crusher equipment shall be fitted with fully operational <br />spray bars to reduce blowing coal dust onto adjacent <br />properties. <br />4. In accordance with applicant's testimony, all operations <br />shall be conducted in compliance with local, state and <br />federal laws relating to fugitive dust control. <br />5. That vehicular traffic operating to and from the subject <br />properly comply with the traffic pattern described in <br />applicant's testimony relating thereto presented at <br />the public hearing. Said traffic has been found to be <br />of general public concern and control over said traffic is <br />necessary for the public safety of the residents of <br />. Jacl:sun County; consequently', this Board retains the right <br />to.revicw said traffic pattern and, if necessary designate <br />a different traffic pattern or a route pursuant to a <br />proper public Bearing. <br />G. Applicant shall enter into an agreement with the County of <br />Jaclaon, State of Colorado, regarding the present and future <br />repair and/or maintenance of Jackson County Road 38 and <br />related structures. <br />7.
