Top of Dam Hlevation <br />• The top of dam elevation will be 20.2 feet. The emergency spillway crest <br />elevation of 17.9 feet plus 0.53 feet of peak flow depth equals 18.43 feet, <br />leaving 1.77 feet of freeboard. This ie sufficient freeboard to resist over- <br />topping by waves. <br />Inspection Procedures <br />A qualified registered professional engineer, or a qualified person under his <br />direction, shall inspect the impoundment. Inspections shall be made quarterly <br />until release of the performance bond. The qualified registered professional <br />engineer shall promptly, after the quarterly inspection, provide to the <br />Colorado Department of Minerals and Geology (CDMG) a certified report that the <br />impoundment has been maintained as designed and in accordance with the <br />approved plan. <br />The inspection report will include any appearances of instability, structural <br />weakness, hazardous conditions, depth and elevation of impounded waters, <br />existing storage capacity, and any other aspects of the structure affecting <br />stability. A copy of all reports and inspections shall be retained at the <br />mine Bite. <br />EMERGENCY PROCEDURES -- If any examination or inspection discloses that a <br />• potential hazard exists, the person who examined the impoundment will promptly <br />inform the CDMG of the findings and of the emergency procedures formulated for <br />public protection and remedial action. if adequate procedures cannot be <br />formulated or implemented, the CDMG will be notified immediately. <br />Pond Justification <br />This permanent impoundment will be a developed water resource, consistent with <br />the poatmining land use and reclamation plan map of Permit C-80-001. <br />Postmining urea of the water in this impoundment will include, but not be <br />limited to, stock and terrestrial wildlife watering. <br />Historically, the water level in the Moffat sediment pond has had a relatively <br />stable permanent pool. This condition is not expected to change with the <br />permanent impoundment. The configuration of the impoundment is adequate to <br />support the poatmining land uses of rangeland and wildlife habitat. <br />Water quality in this structure is expected to be <br />water quality monitoring results. The previous t <br />monitoring reports for discharge point 004 (NPDES <br />indicated acceptable water quality levels for pH, <br />• Technical Revision 32 4.6R-3 <br />adequate based upon peat <br />tree years of NPDES <br />Permit No. C-00032638) <br />total suspended solids, <br />September 5, 1995 <br />
