As noted above, Rockcastle believes Wat a <br />formal request for bond release/reduction and the requisite public notices have been filed. <br />If necessary, please consider this letter to reiterate that request. Accordingly, Rockcastle <br />expects your office to move forward with the release of $32,244 and $18,906 immediately. <br />Rockcastle will notify you upon completion of the Pond 4 slope regrading and other on site <br />activities described above and would expect the balance of the bond amount for regrading <br />($15,603) and road buttressing ($15,000) to be returned at that time. The remaining bond <br />amount which exceeds $50,000.00 (approximately $2,551) will be requested upon final <br />resolution of the lingering issues for Pits 5, 6 and the implementation of the agreed upon <br />reclamation activities, if any. Rockcastle hopes to reach such a resolution in time to <br />complete such activities in conjunction with the Pond 4 regrading project. <br />With respect to the schedule for undertaking the reclamation activities specified <br />herein, Rockcastle would commit to commence the on-site work (weather permitting) as <br />• soon as possible following your approval of the enclosed plans for the Pond 4 regrading <br />project and your concurrence with the bond release schedule set forth above.
