Accordingly, we would request <br />that you retain $15,603 pending completion of the Pit 4 regrading and release the balance <br />of $32,244 immediately. Upon documentation of the completion of the Pit 4 regrading, <br />topsoiling and reseeding activities as set forth in Attachment 2, we understand that the <br />remaining $15,603 would be released. <br />in <br />The Agreement contemplates the release of $18,906 upon completion of the required <br />reseeding activities. Rockcastle has formally requested this release in its November 30,1990 <br />request and all procedural requirements have been completed. <br />Enclosed with this letter you will find copies of the seed tags along with a letter from <br />ACZ which documents that the approved seed mixture was applied in accordance with <br />permit requirements (Attachment 3). On this basis, we would request that the $18,906 be <br />released immediately. <br />• Road Buttresses <br />In recent inspection reports and meetings, your staff has asserted that the road <br />buttress constructed by Rockcastle to stabilize a slide area requires an additional buttress <br />material at its foot in order to comply with the approved design. In addition, you have <br />requested that buttresses be installed at slide azeas 1 and 4 as contemplated by the ACZ <br />report dated November 27, 1990 and subsequent letter dated January 30, 1991. Rockcastle <br />intends to complete the requested buttress improvements and additional work in accordance <br />with the approved design in conjunction with the Pit 4 regrading project referenced above. <br />Under § V.3 of the Agreement, $15,000 of the bond was allocated to cover the buttress <br />issue. Rockcastle requested release of this amount in its November 30, 1990 letter and <br />understands that the requested amount will be released upon completion of the work. <br />Pits 1. 2. 3. 5 and 6 <br />The letter from Mr. Barry set forth the remaining issues regarding Pits 1, 2, 3, 5 and <br />6 as well as pending issues from a letter ident~ed as the October 23, 1941 letter. <br />Rockcastle has directed ACZ, Inc. to work directly with your staff to respond to each <br />remaining item in that letter and to develop a plan for implementing the measures required <br />by the responses. This information will be submitted to your office under separate cover <br />by October 30, 1991. <br /> <br />
