EXHIBIT D <br />Mining Plan <br />a) Mining is estimated to commence upon permit approval and to continue for an <br />indefinite time. <br />b) Approximately 2 inches of plant growth medium will be salvaged and <br />stockpiled in the mining area for use in the reclamation process. <br />c) Approximately 12 inches of overburden needs to be removed to reach the <br />deposits. <br />d) Sand /gravel deposits vary in depth with a 5 foot average. <br />e) An existing access road will be used to access the mining area from State <br />Highway 125. "111ere will be no office, maintenance buildings or underground <br />openings. <br />t) Pit excavation will be limited to a 20 acre area. The limits of mining were <br />determined by test holes. The permit boundaries aze mazked with stakes and <br />red flagging. Excavation will be done from north to south. <br />g) The access road is already established. <br />h) There will be no water used in conjunction with this mining operation. <br />i) We do not anticipate encountering any ground water on site. <br />j) Colorado water laws and regulations governing injury to existing water rights <br />is not applicable in this operation. <br />k} The affected azea is located in a rural azea and no refuse, acid or toxic <br />producing materials will be encountered. If these materials aze found, they <br />will be disposed of as specified by Colorado laws and regulations. <br />1) The mining is to remain above the water table. The depth of the excavation <br />shall be limited to at least two feet above the water table at all times. In the <br />event that ground water is exposed, the operator will cease excavation, notify <br />the Division within 24 hours of exposure, and backfill to an elevation at least <br />two feet above the exposed water. <br />m) There will be no processing equipment on site. <br />n) The primary commodities to be mined will be road base and sand material for <br />local use. <br />o) There will be no incidental products mined other than those previously <br />described. <br />
