.. . ~~.
PSr. Bill Malouff
April 28, 1982
Page -2-

Rs you are undoubtedly aware, it is important that you submit your warranties
and be issued a permit on the Bucky Clanch Pit as soon as possible, and certainly
before the May 26th hearing. This will be a definite factor in the Board's
decision concerning your civil penalty.
I have enclosed one copy each of our financial warranty form for use with a
certificate of deposit and:A performance warranty form. To date, we have only
your $1,000 certificate of deposit (number 1721) on file as the bond for the
Nichols Pit, file number 79-1G7. ~ This must be accompanied by the proper
warranties in order to properly bond this pit. I have (as Mike Stanton did on
one of our old bond forms on Pctober 8, 1981) filled out these forms as per
your permit for this operation. Please sign each of these forms (having your
signature notarized, in each case) and send them back to us to place with your
certificate of deposit as soon as possible. This matter should be properly
settled at some time before the end of May.
Since I will be on annual leave from April 30th through May 19th, please direct
all correspondence and telephone calls to Joe Zalkind or (in the case of the
Nichols Pit) Mike Stanton. I appreciate your cooperation in all of these matters.
Sincerely,
MSL:ys
Enclosures
P~~ ~.
Mark S.
