As you are aware, Burnett Construction Company has a permit (no. 77-190) on <br />the Gomez half of this operation. <br />The Board approved your application for a mining and reclamation permit for the <br />Bucky Clanch Pit, file no. 77-190, and set the amount of financial warranty at <br />$1,000. Upon receipt of the properly executed financial and performance warranties, <br />a permit will be issued to you for this operation. <br />I have enclosed a copy of the Board meeting minutes for both of these items, for <br />purposes of further clarification. <br />Please be advised that, on May 26, 1982, at 9:00 a.m., or as soon thereafter as <br />it may be heard, the Mined Land Reclamation Board will hold a formal public <br />hearing to reconsider the arm unt of the civil penalty against you for the Bucky <br />Clanch Pit, file no. 82-33. At the January 27, 1982 meeting of the Board, this <br />penalty was set at $10,000.00 with $7,500.00 to be suspended upon timely issuance <br />of a permit on this operation. various continuances of Board time limits in <br />this matter have been granted, and the final decision concerning the unsvspended <br />amount of the civil penalty will be made by the Board during the May 26, 1982 <br />hearing. The hearing will be held in Room 110 of the Centennial Bldg., located <br />at 2313 Sherman, in Denver. At the time of the hearing, you may wish to be <br />represented in front of the Board in person and/or by your attorney. In any <br />case, it is strongly advised that you be represented at this hearing. <br />
