Replacement water will be supplied from the following sources: <br />1. 1998 Effluent Lease (1998 Lease) with the Citxof Westminster <br />The 1998 Lease has been used as a replacement source for individual SSP's that have <br />been approved in the past. This is a perpetual lease that provides 0.28 cfs of fully <br />consumable water every day of each year and an additional 0.17 cfs of fully consumable <br />water every day from October 1 ~ to June 30a' during each year at the outfall of the Metro <br />Wastewater Treatment Plant. The lease provides 294.79 acre-feet annually. <br />2. 1999 Effluent Lease (1999 Lease) with the Citv of Westminster <br />A conditional lease of a maximum duration of eight yeazs with the City of Westminster, <br />signed on December 21, 1999, will provide 2.0 cfs of fully consumable effluent every <br />day from November 10 to March 20 beginning on November 10, 2000. At the discretion <br />of the City, replacements can be made at either the Metro Wastewater Treatment Plant or <br />the Big Dry Creek Wastewater Treatment Plant. The lease provides 515.70 acre-feet <br />annually. <br />3. Silver Heights Effluent Lease <br />Silver Heights Water and Sanitation District ("Silver Heights") has an agreement with the <br />Plum Creek Wastewater Authority to treat Silver Heights' consumable wastewater at the <br />Plum Creek Wastewater Treatment Plant (the "Plant"). Silver Heights and Aggregate <br />entered athree-year lease agreement for this consumable water in October 1997; the lease <br />was renewed in January 2004. The lease is based on average flows generated by Silver <br />Heights. These flows averaged 35 acre-feet per yeaz or 2.91 acre-feet per month. <br />4. Historic Use of 1.323 Shares in the Brighton Ditch <br />Aggregate currently owns 4/14« share in the Brighton Ditch Company and leases an <br />additional 1.037 shazes from the City of Westminster. Collectively, the 1.323 shares <br />provide approximately 182.7 acre-feet per year of consumptive use credit based on dry- <br />yeazyields. <br />A substitute water supply plan for the site was submitted to the State Engineer's Office for <br />approval on September 19, 2003 and was subsequently approved on February 18, 2004. The <br />contently approved SWSP covers estimated depletions to the river during the first year of <br />operations. Renewals will be submitted to the State Engineer's Office on an annual basis to <br />account for any changes in operations at the site since the previous approval. <br />After reclamation has been completed, there will be no permanently exposed groundwater at the <br />site.
