Please provide <br />a plan which discusses how and when the seepage loss in the ditch will be detemuned, reporting of <br />seepage loss results to the owners/operators of the ditch and to the Division, and for monitoring flows in <br />the ditch during de-watering operations. <br />6.4.12 EXHIBIT L -Reclamation Costs <br />16. Please verify that the Stroh Pit will be bonded by two (2) distinct phases. Please note that if the <br />operator wishes to begin disturbance in the second phase of the operation prior to securing written <br />approval of seepage loss from the Office of the State Engineer for the Phase 1 pond, then the operator will <br />need to supply additional bond for Phase 2 of the project. Please respond. <br />17. As mentioned in Item 7 above, the applicant will need to revise Exhibit L to include the cost for <br />backfilling the maximum volume of overburden to be stockpiled at the site at any one time. Please <br />respond. <br />18. The applicant has specified reclamation of two (2) lined water storage ponds. The surrounding azeas <br />will be topsoiled and revegetated with a grass mix. The Phase 1 pond will be 15 acres in size and consist <br />of 364 lineaz feet of liner. The Phase 2 pond will be 50 acres in size and will consist of 6524 ]ineaz feet of <br />liner. Please revise Exhibit L to include the following itemized costs for each phase: I) backfill & grading <br />of pit highwalis and/or backfilling of excess overburden to achieve desired 3:1 slopes pond slopes, 2) <br />topsoil replacement at a depth of 2' for surrounding azeas, 3) revegetation of surrounding azeas, 4) <br />mobilization & demobilization of reclamation equipment, 5) pond de-watering assuming each pond has <br />filled with groundwater, 6) pond liner construction QaQc, and 7) pond liner construction including a) rip <br />shale from pit floor, b) spreading liner material, c) moisture conditioning, blending, grading, and <br />compacfing of lifts. Attached is an example copy of a previous Exhibit L which includes these various <br />itemized costs. Please respond. <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />19. Please revise Exhibit S and the mining and reclamation plan maps to verify that the applicant will <br />maintain a 50 foot setback on either side of the Kaneb 8-inch diameter, high pressure, liquids petroleum <br />pipeline that runs north-south throughout the permit azea. The Division requests that the applicant reaffirm <br />their original commitment to maintain a setback distance of 50 feet from the centerline of the pipeline and <br />will mine the adjacent slopes at a 3:1 configuration. The Division also requests that the applicant commit <br />to locating and identifying the location of the centerline of the pipeline and 50' setback on either side of <br />centerline prior to excavation at the site. Please address. <br />20. Attached aze review comments and concerns from Dale E. Smith of Kaneb Pipeline. Please address. <br />Once again, I will look forwazd to your response on or before August 12, 2003. Rule 1.8.1 states that <br />changes and additions to the pemlit application must be filed with the Division and the County Clerk and <br />Recorder. The applicant must also provide the Division with an affidavit or receipt demonstrating that the <br />change or addition was filed with the County Clerk and Recorder no later than the close of business on the <br />day the change was filed with the Division. <br />
